LSTAR ANNUAL GENERAL REVIEW 2022
ARBITRATION
The mandate of the Arbitration Committee is to arbitrate disputes over
commissions between Firms as defined in Article 8 of LSTAR's Bylaws. The
Committee is responsible to review all pertinent material provided to make an
informed, unbiased decision as defined in Article 8 of LSTAR's Bylaws.
In 2022, there were a total of five Arbitration Claims. Three were resolved
through conciliation, and one is currently in progress. There were two Appeals
filed with OREA that have yet to be resolved.
DISCIPLINE
Upon the referral of a matter by the Professional Standards Committee, the
mandate of the Discipline Committee is to hold a Hearing to determine if the
Respondent has engaged in the conduct as set out in the Referral Document
and to discipline any Member if so determined as defined in Article 9 of LSTAR's
Bylaws.
The committee recommended and the Directors approved the following update
to LSTAR's Bylaws, which the Membership approved at the LSTAR AGM on
June 28.

Article 9 ­ Professional Standards, Discipline and Appeal ­ Section
15 Decisions and Penalties ­ 15.01 b) (iii) ­ that the London and St.
Thomas Association of REALTORS® Bylaw be amended and approved
to state that the maximum fine issued by the Discipline Hearing Panel be
increased from $5,000 to $30,000 to reflect the severity of the infraction.
In 2022, there were 17 Discipline Hearings and 13 of the Hearing Decisions
resulted in Fines; 16 had additional education assigned; and 1 was dismissed.
The Fines levied reflected the severity of the breach and ranged from $500 to
$5,000.
