Since the introduction of the Nutrition and Health Claims (NHCR) legislation in
2007 only certain health claims can be made for certain nutrients. The following
information is from the European Food Safety Authority (ESFA), part of the
European Commission:
A health claim is any statement about a relationship between food and health. EFSA is responsible for
evaluating the scientifi c evidence supporting health claims. The Commission draws up lists of health
claims (i.e. NHCR) including the different types of authorised and rejected health claims according to
research ESFA scientists deem suitable. The Commission authorises different health claims provided
they are based on scientifi c evidence and can be easily understood by consumers.
However, at the time of publishing this catalogue the nutritional industry is challenging the NHCR.
We view this legislation as unfair and in many ways inappropriate, especially in the light of them
rejecting claims like water helps hydrate the body!
