Most courts will want to see both parents having a presence in their child’s life, but sometimes one parent may be granted “sole physical custody.” While the term “physical custody” refers to which parent has physical possession of the child, “legal custody” enables a parent to make important life decisions on behalf of the child even if the other parent has sole custody. On the other hand, a parent who is absent or unable to make these decisions will not be granted legal custody in most cases. “Joint custody” is the most common type of child custody, with the child spending time with each parent separately.
