DEFINING EXCEPTIONAL HARDSHIP
Parliamentary Legislation
Notwithstanding issues of devolution and the European
Convention on Human Rights, the supreme source of law in
Scotland remains the United Kingdom Parliament at Westminster.
The law regarding exceptional hardship derives from an Act of
the Westminster Parliament, namely the Road Traffic Offenders
Act 1988, in particular Section 35 (1), (3) and (4).
