Exceptional hardship can only be argued in totting-up cases.
Therefore, it is not competent to request an exceptional hardship
proof when faced with a mandatory driving ban, as in drink-
driving and dangerous driving cases.
This booklet aims to provide Scottish motorists with information
and guidance on the definition of exceptional hardship, the types
of situation which may give rise to it, and how to prove in court
that a driving ban would cause exceptional hardship.
