TAx LAWS FOR LObbyING ExPENSE dEdUcTIbILITy NAR’s Midyear Legislative Meetings & Trade Expo is an annual event of the Association in Washington, DC. Most of the time spent at meetings is in furtherance of the business of the Association. In addition, during the Midyear Meetings, members of Congress often address public NAR forums and/or committees, and NAR members also have private meetings with their representatives and senators to discuss specific legislation. Your participation in lobbying activities may adversely affect the deductibility of your expenditures to attend the event. IRS regulations require that members reasonably allocate expenses among nondeductible lobbying activities. For example, the regulations state that if a member of Congress gives a speech at an open forum of a meeting, then the activity is not a lobbying activity. By contrast, if an NAR member meets privately with his/her representative to discuss legislation, then that is a lobbying activity. You will want to keep a record of the meetings you attend to distinguish between published business meetings and lobbying meetings. Check with your own tax advisor to determine what amount, if any, of the expenses for attending the Midyear Legislative Meetings & Trade Expo will be non-deductible because they are lobbying expenses.
